Fault, Criminal vs. Civil—What It Means
Per-se DUI (typically 0.08 BAC for adult drivers) is a criminal standard. The criminal case is separate from your civil claim for money damages. Evidence from the criminal case—BAC tests, police reports, video—often strengthens the civil case.
Idaho uses modified comparative negligence: you can recover if your share of fault is less than the other party’s; any award is reduced by your percentage. (Barred at 50% or more.)
